Title

An ordinance amending Chapter 5 (Buildings and Construction), Article V (Construction of Fences, Section 5-143 (Height Restrictions) of the City Code for the purpose of providing updated regulations for side yard fence setbacks.

Body

Periodically, staff encounter requests for a variance of the City’s Fence Ordinance, specifically limits on key lots, which have limits for the distance between the house and the property line along the side street. This requires a typical backyard fence of six or eight feet in height to be setback at least 25 feet from the property line and along the side street.  The proposed ordinance amendment would allow fences up to eight feet in height in exterior side yards of key lots to be setback 10 feet from the property line.  Several Planned Developments have previously been approved with the 10-foot setback.

The proposed 10-foot setback would allow for a larger fenced in back yard, while maintaining safe visibility for vehicles on the adjacent property.

Recommended/Desired Action

Staff recommends approval of the proposed ordinance.
