Conduct a public hearing and consider an ordinance for Zoning Application No. Z0525-0397 submitted by Austin McDaniel, on behalf of Simple Development Partners, for a Comprehensive Plan amendment to change the future land use designation from Commercial to Light Industrial and a change of zoning from Planned Development (PD) - Light Commercial Ordinance No. 2174 and Traditional Neighborhood Mixed Residential to PD - Commercial with a Conditional Use Permit being granted for a brewery, along with modified development standards to allow a light industrial development that includes uses permitted in the Commercial Zoning District, as well as permitting warehouse distribution, beverage manufacturing, and other manufacturing located at 2100 E US Highway 80.
(No responses in favor and one in opposition to the application have been received from property owners within the statutory notification area. The Planning and Zoning Commission recommends approval with certain stipulations.)
Body
The applicant, Austin McDaniel, on behalf of the developer Simple Development Partners, is requesting a Comprehensive Plan amendment and a change of zoning to allow a light industrial development on a 7-acre tract located southeast of Jane Street and the US Highway 80 service road. The proposed development would include a ~95,000-square-foot tilt-wall building for commercial uses, warehouse distribution, and light manufacturing. Although not formally a party to the application, the developer is working with a Dallas-based brewery that may occupy a significant portion of the building for brewing and distribution operations. The brewer also envisions using the site for a taproom, food trucks, and/or a restaurant.
The proposed Planned Development (PD) would permit all uses allowed by-right in the Commercial Zoning District, in addition to warehouse distribution uses. The PD would also allow assembly of finished products or parts, primarily from previously prepared materials, as a permitted use. All other manufacturing uses would require approval through a Conditional Use Permit (CUP). While the applicant requested that the brewery be permitted by-right, the Planning and Zoning Commission approved it with a CUP. City Council has the discretion to approve the PD with the brewery either permitted by-right or subject to a CUP. Should City Council choose to require a CUP, no separate application will be necessary, as it can be approved with the current application.
On June 23, 2025, the Planning and Zoning Commission recommended approval of the request by a vote of 5-2, with Commissioners Arnold and Teferi dissenting, to allow the light industrial development with a Conditional Use Permit for a brewery.
Recommended/Desired Action
Following the public hearing, staff recommends that the City Council take action.
