Title
Conduct a public hearing and consider an ordinance for Zoning Application No. Z0722-0247, submitted by Scott Harvel, for a change of zoning from Commercial to Commercial with a Conditional Use Permit to allow the outdoor display of used vehicles for sale, located at 2828 Interstate Highway 30, Suite 101.
(No responses in favor and two in opposition to the application have been received from property owners within the statutory notification area. The Planning and Zoning Commission recommends approval with certain stipulations.)
Body
The applicant proposes to use a 3,450-square-foot lease space and up to 16 parking spaces within the newly constructed All Trades development for the display and sale of used cars. The proposed concept plan identifies the spaces designated for display of 16 vehicles. Enough parking exists on the site such that using 16 spaces in this way will not drop the remaining available spaces below the minimum number required for the entire development. Vehicles on display will be moved behind the front building into a secured area when the business is not in operation.
On September 26, 2022, the Planning and Zoning Commission voted unanimously to approve Application No. Z0722-0247, for a change in zoning from Commercial to Commercial with a Conditional Use Permit to allow the outdoor display of used vehicles for sale with the following conditions:
1. Display of vehicles shall be limited to the number of display spaces and display areas as noted on the Concept Plan attached hereto as Exhibit “A”. Display spaces and customer parking shall comply with the parking and access standards in Section 3-400 of the Mesquite Zoning Ordinance.
2. Any vehicle for sale shall be operable and maintained in good condition.
3. No vehicle for sale shall have body damage greater than four inches in diameter.
4. Painted repairs shall match the paint on the rest of the vehicle.
5. Any vehicle for sale shall not have broken or cracked windows.
6. All parking and display surfaces shall be paved except for display surfaces in showroom areas.
7. Any vehicle not ready for sale and in need of repair or detailing shall be kept in the secured area behind the building on a paved surface as shown in Exhibit A or inside of a structure.
8. Prices shall not be painted or drawn in any way on the vehicles, including the windows.
Recommended/Desired Action
Following the public hearing, staff recommends approval of the ordinance.
