A. Conduct a public hearing on the levy of assessments on property within Improvement Area A-5 of the Solterra Public Improvement District.
B. Consider an ordinance approving a Service and Assessment Plan and Assessment Roll for authorized improvements in Improvement Area A-5 in the Solterra Public Improvement District (the “District”), making a finding of special benefit to certain property in the District, levying assessments against certain property within the District and establishing a lien on such property, providing for payment of the assessments in accordance with Chapter 372, Texas Local Government Code, as amended, providing for the method of assessment and payment of the assessments, providing penalties and interest on delinquent assessments, providing for severability and providing an effective date.

On October 6, 2025, the City Council passed Resolution No. 42-2025 to accept a preliminary Service and Assessment Plan (SAP) for authorized improvements within Improvement Area A-5 of the Solterra Public Improvement District (PID).
The proposed ordinance levies assessments on each lot or parcel based on apportioned costs of authorized public improvements that convey a special benefit to each property. The developer fronts the costs of the public improvements and seeks reimbursement through a combination of PID bond proceeds and/or assessment revenue. These public improvement costs, plus authorized PID administrative costs, annual collection costs and bond issuance costs, are then apportioned by the PID Administrator to each parcel or “lot type” on an annual basis in the form of annual installments that are paid by each property owner. The annual installments for each lot type make up the Assessment Roll, which is updated each year in accordance with State law.
Total project costs for Improvement Area A-5 identified in the SAP are $674,925, and the amount subject to reimbursement to the developer is an amount not to exceed $116,000. With only nine lots, Area A-5 is not included in the upcoming bond sale, and public improvements will be reimbursed solely on assessment revenue.
A public hearing is required by State law to receive any written or oral objections to the proposed assessments identified in the SAP. Notice of the public hearing to be held on October 20, 2025, was published in the Daily Commercial Record newspaper on Thursday, October 9, 2025, and notice was sent to property owners within the PID Improvement Area via certified mail on October 8, 2025.
Recommended/Desired Action
After the public hearing is closed, the City Council must hear and pass on any objection to any proposed assessment and may amend a proposed assessment on any parcel within the PID prior to adoption of the ordinance approving the SAP, assessment roll and levy of assessments.
