Ratification of the total expenditure of $369,695.00, without competitive bidding, for the emergency repair of the aerial crossing between Pioneer Road and Faithon P. Lucas, Sr., Boulevard (AC66) and authorizing payment to ANA Site Construction, LLC for such repairs.
Body
On or about July 20, 2026, the 12-inch aerial sanitary sewer line at the Barnhart Aerial crossing failed. The failure occurred between Pioneer Road and Faithon P. Lucas, Sr., Boulevard at North Mesquite Creek and required immediate emergency repair to restore the sewer system and prevent further impacts to public health, safety, and the surrounding area.
Due to the nature and extent of the failure, immediate action was necessary. The City of Mesquite hired ANA Site Construction, LLC to perform the emergency sewer line repair and replacement.
This emergency sewer line replacement met the exemption requirements for emergency procurement under Section 252.022(a)(2) of the Texas Local Government Code, which provides an exemption for “a procurement necessary to preserve or protect the public health or safety of the municipality's residents.”
Financial Implications
The City’s cost of $369,695.00 was paid out of the Water & Sewer emergency fund balance.
Recommended/Desired Action
Staff recommends approval of the ratification.
