Authorize the City Manager to finalize and execute a First Amendment to Mesquite Metro Airport Lease and Indemnity Agreement with ATP USA, INC.

On January 1, 2024, the City of Mesquite entered a lease and indemnity agreement with ATP USA, INC. for 2,000 square feet of office space and 6,000 square feet of hangar space located at 1290 Airport Boulevard. The term of the lease is for two years.
To accommodate their flight training operations, ATP made several upgrades to the facility including painting the interior offices, adjusting the airport fence line to create streetside access, installing a walkway to the facility, upgrading the window blinds, installing internet lines to the facility including drop locations in the offices, and much more. As a part of our agreement with ATP, the City of Mesquite installed an HVAC system in a work area and changed out the exterior locks to the building.
ATP is requesting an amendment to their lease which will lower their monthly rental rate from $6,150.00/mo. to $5,601.04/mo. This discounted rate will last for 20 months and will reimburse $10,979.33 to ATP to offset some of the cost for improvements ATP made to the office and hangar space.
The City Attorney’s office has reviewed the First Amendment.

Staff recommends the City Manager be authorized to finalize and execute a First Amendment to Mesquite Metro Airport Lease and Indemnity Agreement with ATP USA, INC.
