Title

A resolution authorizing the City Manager to finalize and execute an Interlocal Agreement with North Texas Municipal Water District (NTMWD) pertaining to the District’s use of the bridge crossing the East Fork of the Trinity River and related access road within the City of Mesquite.

Body

North Texas Municipal Water District (NTMWD) is requesting an Interlocal Agreement (ILA) with the City of Mesquite for use of the City access/maintenance road and bridge crossing the East Fork of the Trinity River. The agreement grants NTMWD access to transport equipment, materials, and personnel necessary for the construction and maintenance of pipelines and facilities across Barrel Ranch, LLC property.

Under the ILA, NTMWD will be responsible for all damages to the bridge and road caused by its use, including those by contractors and subcontractors. NTMWD will also be responsible for obtaining any required easements from Barrel Ranch, LLC for access. This will allow for long-term agreement to be put into place between both parties. As part of the agreement, NTMWD is providing funding to offset the City’s investment in the bridge. The ILA also outlines the process for access to the easement to alleviate concerns of the property owner.
