Title
A resolution authorizing the sale of multiple tax-foreclosed properties located in Mesquite, Texas, ratifying and approving offer and purchase agreements and authorizing the City Manager to execute quitclaim deeds and all other documents necessary to complete the closing and sale of the properties.
Body
A list of tax-foreclosure properties is posted on the City's website. The City received offers on certain tax-foreclosed properties that included 11 vacant lots and two properties with structures. The tax codes that are applied to the offers include:
* Texas Tax Code ?34.05(j). A sale under this code discharges and extinguishes all liens foreclosed by the judgment and all post-judgment taxes, penalties and interest, except for prorated taxes for the year of closing, and requires the consent of all taxing units entitled to proceeds of the sale. This code applies to the offers made on the 11 vacant lots.
* Texas Tax Code ?34.05(i). A sale under this code requires the purchaser to pay the post-judgment taxes, penalties and interest to the taxing entities and requires the consent of all taxing units entitled to proceeds from the sale. This code applies to the offer made on the property located at 1224 Powell Road.
* Texas Tax Code ?34.05(h). A sale under this code requires the purchaser to pay the post-judgment taxes, penalties and interest to the taxing entities, but it does not require the consent of the taxing entities. This code applies to the offer made on the property located at 911 Jardin Drive.
Those offers that required the consent of the taxing entities were approved by the Mesquite Independent School District's Board of Trustees on February 13, 2017. The Dallas County Commissioners Court is expected to give consent at its March 7, 2017, meeting.
Recommended/Desired Action
Staff recommends Council approval of the resolution.
