Title
Authorize the City Manager to finalize and execute a Wastewater Service Agreement between the City of Mesquite and Bellagio 443 LLC, for provision of wastewater collection service in the City's Extraterritorial Jurisdiction (ETJ).

Body
Bellagio 443 LLC, proposed a residential development in Mesquite's Extraterritorial Jurisdiction (ETJ) through the establishment of a Municipal Utility District (MUD) on Markout Central Road, west of FM 740. The development will be comprised of approximately 1,200 single-family homes.

The proposed development is adjacent to the City limits and the City has established an agreement with the City of Forney for the provision of wastewater services in the area. As the development is within Mesquite Certificate of Convenience and Necessity (CCN) which provides the City the ability to provide water service, it is proposed that the City provide wastewater service for the development. The City currently has an agreement with the City of Forney to utilize the Buffalo Creek Interceptor system which serves Forney, Heath and Rockwall. The system has significant capacity to accept the anticipated wastewater from the development until the City constructs additional sewer infrastructure in the area.

Without this agreement, the Bellagio development would be able to develop their own wastewater treatment facility within the City's ETJ and discharge effluent water from the facility into the Trinity River. Utilization of the established wastewater treatment system, which is treated at the North Texas Municipal Water District (NTMWD) Treatment Facility in Mesquite, is a more desirable option for the City and other property owners and residents in the area.

The developer currently has a petition before the Texas Commission on Environmental Quality (TCEQ) for a wastewater treatment facility, and with this agreement, the developer will withdraw that application.
