Conduct a public hearing and consider an ordinance for Zoning Application No. Z0621-0204, submitted by Allen Perez of JM Civil Engineering, for a change of zoning from Planned Development - Service Station Ordinance No. 3016 to Planned Development - General Retail Ordinance No. 3016 to allow a convenience store and fueling station, located at 1712 West Scyene Road.

Body

The original application was to rezone to Planned Development - Commercial. However, after working with the applicant, the request has been changed to rezone to Planned Development - General Retail that permits uses that are more appropriate and is consistent with recommendations of the Comprehensive Plan.

 

The applicant proposes to demolish the existing convenience store, fueling facilities and carwash building and construct a new Murphy Express convenience store with eight fuel pumps (16 fueling positions). The proposed development would include more landscaped area and more trees than typical commercial development requires.  The Planned Development would allow the convenience store and fuel pumps to be 400 feet from a residential zoning district (Iron Horse) instead of the required 500 feet.

 

On July 26, 2021, the Planning and Zoning Commission voted 6-0 to approve a change of zoning from Planned Development - Service Station to Planned Development - General Retail.

 

Recommended/Desired Action

Following the public hearing, staff recommends approval of the ordinance.
