Title

Conduct a public hearing and first reading for an ordinance imposing a moratorium on applications and plans for development, for permits, plats, verifications, rezoning and site plans for convenience stores within the corporate limits of the City of Mesquite, adopting written findings justifying the moratorium, providing for waivers and limited exceptions to the moratorium and establishing an expiration date.

 

Body

On January 28, 2020, the City Council will conduct a public hearing and consider approval of an ordinance on first reading.

 

Earlier, on January 27, 2020, the Planning and Zoning Commission held the first statutory public hearing and a temporary moratorium will take effect on January 30, 2020, for new applications for convenience stores. This temporary moratorium will expire no later than February 9, 2020, if Council takes no action.

 

To continue the moratorium while staff has time to review applicable regulations, it is necessary to conduct three public hearings and adopt an ordinance on two separate readings. This is the second public hearing, and a third and final public hearing and adoption of the ordinance is scheduled for February 3, 2020.

 

The ordinance includes a statutorily required waiver process and a procedure for other limited exceptions. If approved, the moratorium may last up to 120 days with the possibility of an extension. Unless extended, the moratorium would expire the earlier of June 2, 2020, or Council adoption of an ordinance regarding convenience stores.

 

Recommended/Desired Action

Staff recommends approval of the ordinance on first reading.
