Authorize the City Manager to finalize and execute a Water Disconnection Agreement with Talty Special Utility District.

 

Body

The Talty Special Utility District (Talty SUD) holds a Certificate of Convenience and Necessity (CCN) to allow Talty SUD to provide retail water service to areas within the City of Mesquite. The Water Disconnection Agreement is a general agreement that provides for the cooperation between the City of Mesquite and the Talty SUD regarding exchange of utility account information, water consumption data and disconnection of service for non-payment of water bills for utility customers in the City of Mesquite.

 

Developments that are within the City of Mesquite and also within the Talty SUD CCN include the 269 Lot, Berkshire Estates Addition that is currently under construction and the proposed Wynn-Jackson Industrial Park on FM 2932.

 

Financial Implications

The Agreement provides for the payment to Talty SUD of fees associated with the disconnection of water service for the benefit of the City due to non-payment of sanitary sewer fees. These payments to Talty SUD for disconnection and reconnection of service would be passed onto the customer; therefore, the financial impact is considered negligible.

 

Recommended/Desired Action

Staff recommends the approval of the Water Disconnection Agreement with Talty Special Utility District and authorizing the City Manager to finalize and execute the Agreement.
