Title

An ordinance amending the City Code by revising certain sections in Chapter 10 (Offenses - Miscellaneous), Article V (Condition of Premises) for the purpose of updating the provisions related to high weeds, high grass, and edging requirements, landscaping and vegetation maintenance requirements and tree maintenance requirements.

Body

An ordinance amending Chapter 10, Article V, of the City Code, providing updates to the provisions in the sections involving the maintenance of high grass and high weeds, edging, landscaping, and tree maintenance. 

 

The proposed amendments have been previously discussed in policy discussions and align with the City Council’s Strategic Goals for maintenance of attractive neighborhoods and enhancing safety.  The update to the high grass and weeds section clarifies the area of property owners' responsibility and incorporates edging provisions. The updates to the landscape ordinance provisions decrease the allowable coverage of the height of shrubs around windows, which would improve egress access in the event of an emergency.  Lastly, the updates related to tree maintenance provisions for obstructing trees and vegetation within the same section of the City Code.

 

Summary of revisions proposed include:

 

                     Amend Section 10-127 - Update language and description of owner’s responsibility of maintenance related to high grass, high weeds, and edging.

                     Amend Section 10-128 - Update description of owner’s responsibility, clarifying language defining offenses, and reducing window coverage percentage from 75 percent to 50 percent.

                     Amend Section 10-133 - Providing provisions for the maintenance of trees and shrubs to address obstructions of visibility and overhead clearance.

  

Recommended/Desired Action

Staff recommends approval of the ordinance.
