Title

An ordinance determining the necessity of acquiring real property for construction of a public park on property located at 1100 North Bryan-Beltline Road; authorizing appropriation of the real property and/or the use of the power of eminent domain to acquire the real property for public use; and delegating authority to initiate condemnation proceedings to the City Manager.

 

Body

The subject property has been identified for the construction of a pocket park for public recreational purposes. The City’s right-of-way agent has made several contacts with the property owner starting on March 11, 2021, to discuss terms and value but has been unsuccessful in completing negotiations and closing on the property. The proposed ordinance authorizes staff to continue negotiations and, if necessary, initiate condemnation proceedings.

 

Section 2206.053 of the Texas Government Code mandates specific wording for a motion to initiate condemnation proceedings. Staff will furnish the appropriate wording at the Council meeting.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
