An ordinance amending Chapter 5 (Buildings and Construction), Article V (Construction of Fences), Section 5-142, to be retitled (Public Property Access Control) of the City Code for the purpose of prohibiting gates, exceeding five feet, to be constructed on private fences to allow access to an unimproved alley, drainage and/or other utility easement, or other unimproved land unless specifically authorized by the City for maintenance or emergency access, and revising section 5-144 (Materials) for the purpose of prohibiting the addition of privacy fence mesh screen or similar materials and/or privacy fence inserts or slats to chain-link fences.
Body
City staff have observed increasing instances of property owners installing unauthorized gates on private fences to access unimproved alleys and utility easements, which has led to concerns about unauthorized vehicle access and potential safety hazards. Additionally, there has been a growing trend of residents modifying chain-link fences with aftermarket privacy screens and slats that deteriorate quickly, creating unsightly conditions and maintenance issues throughout the City. These practices have resulted in complaints from residents and challenges for maintenance crews who require proper access to these areas for regular maintenance and emergency situations.
This proposed ordinance amends the City Code to address specific issues related to public property access and fence materials. The proposed language retitles Section 5-142 as "Public Property Access Control" and prohibits gates exceeding five feet in width on private fences that provide access to unimproved alleys, drainage/utility easements, or other unimproved land, unless specifically authorized by the City for maintenance or emergency access. Additionally, Section 5-144 (Materials) is revised to prohibit the addition of privacy fence mesh screen or similar materials and/or privacy fence inserts or slats to chain-link fences.
