An ordinance providing for the partial abandonment of a 15-foot-wide drainage easement located at Town East Mall to accommodate the construction of a proposed retail development.
Body
A representative of General Growth Properties has requested partial abandonment of a 15-foot-wide drainage easement at Town East Mall which was originally dedicated by plat in 2012.
This requested abandonment releases a portion of the original drainage easement that conflicts with the proposed retail development building. The portion of drainage easement to be abandoned contains drainage piping ranging in size from 10-inch to 24-inch in diameter. Engineering plans for the proposed retail development include a relocated drainage system that will replace the abandoned lines. The project will also dedicate new easements for the relocated drainage system.
The easement is exclusively a City drainage easement with no other franchised utilities having authority to occupy the easement. 1519 Surveying, LLC, has prepared the necessary survey and legal description for the portion of the easement to be abandoned.
The City Attorney’s office has reviewed state law and City procedures and believes that this abandonment is in conformance with law and procedures.

Staff recommends approval of the ordinance.
