Receive briefing regarding an exchange of extra-territorial jurisdiction with the City of Forney.

Over the past several months, staff for the Cities of Forney and Mesquite have been discussing an exchange of extra-territorial jurisdiction (ETJ) and smoothing of water supply entity boundaries in Kaufman County. After reviewing several factors including the proximity to city water and sewer services and school districts, Mesquite staff proposed releasing 1,851 developable and 2,211 undevelopable acres north of IH 20 to Forney in exchange for Forney releasing 667 developable and 39 undevelopable acres - a 3 for 1 ratio of developable land in Forney’s favor. Forney has countered by reducing its release of developable land in its ETJ to 499 acres and undevelopable land to 17 acres. The Forney proposal changes the developable land swap ratio to 4.5 to 1 in Forney’s favor. Furthermore, Forney does not want the release of 206 undevelopable acres in Dallas County that lies east of the East Fork of the Trinity River.
Staff will present both proposals during the Council Pre-Meeting for discussion.
Recommended/Desired Action
Staff will seek Council direction regarding the Forney ETJ release counter proposal.
