An ordinance providing for the partial abandonments of a 10-foot-wide utility easement and a 30-foot fire lane and utility easement located at the Market East Shopping Center, 1645 and 1649 Town East Boulevard.

 

Body

A representative of the Fidelis Realty Partners has requested partial abandonments of a 10-foot-wide utility easement and a 30-foot fire lane and utility easement located at the Market East Shopping Center, 1645 and 1649 Town East Boulevard. (See attached legal description and sketches.)

 

Research of the Dallas County land records indicates that both easements were dedicated for the construction of the shopping center when the original subdivision was platted. The easements contain various franchise and City utilities that have been relocated by the applicant as part of the approved engineering plans that are currently under construction.

 

Stantec Consulting Services, Inc., has obtained confirmation letters from the four franchise utility companies: ONCOR Electric Delivery, Atmos Energy, AT&T and Time Warner Cable, indicating they have no facilities in the subject easement and no objection to the abandonment.  Stantec Consulting Services, Inc., has also had the necessary survey and legal description prepared for the portions of the easements to be abandoned.

 

The City Attorney’s office has reviewed state law and City procedures and confirms that this abandonment is in conformance with law and procedures.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
