Title
An ordinance providing for the abandonments of several 15-foot-wide water line, sanitary sewer and storm sewer easements located on a vacant tract of land to the west of East Meadows Boulevard and north of the West Fork of South Mesquite Creek; otherwise known as East Meadows Addition No. 1, Block A, Lot 2.

Body
A representative of the FLT Associates, Ltd., has requested abandonments of several 15-foot-wide water line, sanitary sewer and storm sewer easements located on a vacant tract of land to the west of East Meadows Boulevard and north of the West Fork of South Mesquite Creek; otherwise known as East Meadows Addition No. 1, Block A, Lot 2, containing 12.982 acres. (See attached legal description and sketches.)

Research of the Dallas County land records indicates that the subject easements were dedicated by plat in 1985 for the planned construction of an apartment complex. The apartment complex was never constructed and the subject easements contain no active franchise or City utilities. The property is currently zoned commercial and Athlos Academies is pursuing this abandonment to prepare the site for construction of a charter school on the tract.

Big Red Dog Engineering and Consulting, Inc., has obtained confirmation letters from the four franchise utility companies: ONCOR Electric Delivery, Atmos Energy, AT&T and Spectrum, indicating they have no facilities in the subject easement and no objection to the abandonment. Big Red Dog Engineering and Consulting, Inc., has also had the necessary survey and legal description prepared for the easements to be abandoned.

The City Attorney's office has reviewed state law and City procedures and confirms that this abandonment is in conformance with law and procedures.

Recommended/Desired Action
Staff recommends approval of the ordinance.
