An ordinance associated with Application No. 0517-0005 to approve a change of zoning from R-1 Single-Family Residential to Planned Development-General Retail allowing a grocery store located at the southeast corner of East Cartwright Road and Wilkinson Road.

On August 21, 2017, the City Council approved stipulations for Application No. Z0517-0005, rezoning from R-1, Single-family Residential to PD-GR, Planned Development-General Retail for the property located at the southeast corner of East Cartwright and Wilkinson Roads. The rezoning is for a Lidl grocery store. This agenda item is to consider the PD ordinance for that rezoning.
A few modifications to the stipulations and concept plan have been made since the August 21, 2017, meeting. Specifically, the tract line that created two tracts has been removed. Other wording throughout the stipulations has been modified to remove tract number references. This will help assure that any future development of the open space portions of the parcel will go through a PD amendment process if the land is to ever be subdivided and/or developed. Other stipulations have been added as directed by the Council in the motion for approval at the August 21, 2017, meeting.
Recommended/Desired Action
Staff recommends approval of the proposed ordinance.
