Authorize the City Manager to finalize and execute a reimbursement agreement with MCI for the relocation of approximately 2,370 feet of long distance fiber cable, located within the Union Pacific Railroad right-of-way, associated with the reconstruction of Town East Boulevard from Military Parkway to Skyline Drive in the amount of $82,793.60.

Town East Boulevard, from Military Parkway to Skyline Drive, is currently under construction, which includes lowering the roadway under the Union Pacific Railroad (UPRR) bridge to provide an increase in the clearance height for the industrial truck traffic. Within the UPRR right-of-way, MCI has an existing long distance fiber cable which is in conflict with portions of the project and needs to be relocated. The cable extends across the country from coast to coast and is an extremely critical piece of communication infrastructure. Since the cable is not located within the City’s right-of-way, the City cannot require the cable to be relocated to accommodate the reconstruction of Town East Boulevard. The proposed agreement allows MCI to relocate the cable as needed and authorizes reimbursement to MCI for their relocation services.
Financial Implications
Funds have been previously allocated for this relocation as part of the Town East Boulevard reconstruction project.
Recommended/Desired Action
Staff recommends the City Manager be authorized to finalize and execute a reimbursement agreement with MCI.
