A resolution authorizing the sale of three tax-foreclosed properties located at 3821 East Cartwright Road, 1700 South Sam Houston Road and 112 West College Street in Mesquite, Texas, ratifying and approving offer and purchase agreements and authorizing the City Manager to execute quitclaim deeds and all other documents necessary to complete the closing and sale of the properties.

A list of tax-foreclosure properties is posted on the City's website. The City received offers on three tax-foreclosed properties that were vacant lots. The tax codes that are applied to the offers include:
* Texas Tax Code ?34.05(h). A sale under this code requires the purchaser to pay the post-judgment taxes, penalties and interest to the taxing entities, but it does not require the consent of the taxing entities. This code applies to the offer made on the property located at 3821 East Cartwright Road.
* Texas Tax Code ?34.05(j). A sale under this code discharges and extinguishes all liens foreclosed by the judgment and all post-judgment taxes, penalties and interest, except for prorated taxes for the year of closing, and requires the consent of all taxing units entitled to proceeds from the sale. This code applies to the offers made on the properties located at 1700 South Sam Houston Road and 112 West College Street.
Those offers that required the consent of the taxing entities were approved by:
* The Mesquite Independent School District's Board of Trustees on November 13, 2017, for the sale of 1700 South San Houston Road and on December 18, 2017, for the sale of the property of 112 West College Street.
* The Dallas County Commissioners Court on November 21, 2017, by Court Order 2017-1524 for the sale of 1700 South Sam Houston Road and on December 5, 2017, by Court Order 2017-1602 for the sale of 112 West College Street.
Recommended/Desired Action
Staff recommends Council approval of the resolution.
