Title
A resolution authorizing the purchase and sale of a tax-foreclosed property located at 402 North Carmack Street, Mesquite, Texas, and authorizing the City Manager to execute a quitclaim deed and all other documents necessary or requested to complete the closing, purchase and sale of the property.
Body
The City owns the property at 402 North Carmack Street in trust due to receiving no bids at a sheriff’s sale earlier this year. The property is needed by the City for future drainage and utility improvements/projects.
Texas Tax Code §34.05(h) allows the City to sell the property if the purchaser pays the post-judgment taxes, penalties and interest to the taxing entities, but it does not require the consent of the other taxing entities. Staff proposed to purchase the property using Drainage Utility District (DUD) funds. The City would pay the total amount of the judgment specified in the judgment ($125,838.73) along with the post-judgment taxes, penalties and interest (approximately $10,936.79) in order to gain full ownership.
Recommended/Desired Action
Staff recommends Council approval of the resolution.
