Title

An ordinance providing for the partial abandonment of Stadium Drive right-of-way located along Frasier Middle School, otherwise known as West Mesquite High School Block A, Lot 1R.

 

Body

A representative of the Mesquite Independent School District (MISD) has requested partial abandonment of Stadium Drive right-of-way located along Frasier Middle School, otherwise known as West Mesquite High School Block A, Lot 1R. (See attached legal description and sketches.)

 

Research of the Dallas County land records indicates that the subject right-of-way was acquired through right-of-way deeds filed February 19, 1938, recorded in Volume 2050, Page 475 and Volume 2054, Page 457 Deed Records, Dallas County, Texas for the improvement of Peachtree Road, now known as Stadium Drive. MISD proposes to build an addition where the subject right-of-way is located. The City will retain a public utility easement in the segment of the right-of-way being abandoned. Franchise utilities have no objections to the right-of-way abandonment, given that the area will remain a public utility easement.

 

On January 3, 2017, the City of Mesquite approved a transfer of land to MISD in exchange for a transfer of land from MISD to the City of Mesquite. As part of this transfer agreement, the City agreed to transfer this portion of Stadium Drive to MISD.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
