Title

Conduct a public hearing and consider an ordinance for Zoning Text Amendment No. 2018-04 amending Section 1-304, Termination of nonconforming situations; thereby revising the regulations pertaining to the amortization of nonconforming uses.

(The Planning and Zoning Commission recommends approval of the zoning text amendment.)

 

Body

On March 26, 2018, the Planning and Zoning Commission voted unanimously to recommend approval of Zoning Text Amendment No. 2018-04.

 

Amortization of nonconforming uses allows the City to terminate nonconforming uses after a pre-determined period in which a business owner can recoup their investment in the business. The Zoning Ordinance currently has provisions for amortization but the provisions have not been exercised.  Staff is proposing amendments to the amortization ordinance that would improve and clarify the procedures for amortization.

 

Recommended/Desired Action

After the public hearing, staff recommends approval of the ordinance.
