Title

Approve the sale of a drainage easement (Parcel 110E) on City-owned property to the Texas Department of Transportation in the amount of $15,053.00 and execution of a Possession and Use Agreement for early possession of the property for an additional consideration of $3,000.00 for the construction of frontage roads on IH 635 and authorize the City Manager to finalize and execute the necessary documents.

 

Body

The Texas Department of Transportation (TxDOT) is pursuing acquisition of right-of-way (ROW) and easements necessary for the construction of service roads on IH 635 as part of the LBJ East Project. As part of this ROW acquisition process, TxDOT has made a final offer for the acquisition of a drainage easement on a piece of City owned land on the east side of IH 635 near the intersection of Childress Avenue and Brazoria Drive. Acquisition of this drainage easement is essential to the project.

 

TxDOT has offered $15,053.00 ($1.19/square foot) for a drainage easement (Parcel 110E) which is roughly 12,676 square feet and an additional $3,000.00 compensation for execution of a Possession and Use Agreement for Parcel 110E. This parcel of land is behind the Advanced Pain Solutions Building at 3862 Childress Avenue. The City owned parcel was dedicated to the City in 2009 by Warranty Gift Deed specifically for extension of Brazoria Drive and a drainage easement for the IH 635 project as there is a large drainage ditch on this parcel.

 

Financial Implications

The City will be compensated $18,053.00 for the drainage easement and execution of the Possession and Use Agreement.

 

Recommended/Desired Action

Staff recommends the City Council approve the purchase offers from the Texas Department of Transportation and authorize the City Manager to finalize and execute the necessary documents.
