An ordinance amending Chapter 10 of the City Code regarding smoking in tobacco shops.
Body
The current ordinance allows smoking in a tobacco shop only within a designated sealed and ventilated room. Smoking is prohibited in areas where employees typically work, including lobby and sales areas. A local cigar business has been allowing smoking throughout their store and would like the ordinance changed to allow them to do so.
The proposed ordinance would allow smoking in freestanding tobacco shops, and in all or portions of tobacco shops that are not free standing if the smoking area is sealed and ventilated. Additional proposed wording provides more specificity to requirements for sealing and ventilating a space.
Staff has compiled and attached information from 13 area cities related to smoking in tobacco shops.
Recommended/Desired Action
As Council deems appropriate.
