Authorize the City Manager to finalize and execute a Fire Hydrant Access Agreement with Kaufman County Municipal Utility District No. 11 to authorize use of fire hydrants for fire protection purposes for a 0.8746-acre tract of land on the southwest corner of Interstate Highway 20 and Farm to Market Road (FM) 741.

 

Body

At the southwest corner of Interstate Highway 20 and FM 741 is a 0.8746-acre tract of land owned by Deal A Day Real Estate, LLC, a Texas limited liability company (“DADRE”), seeking to develop a convenience store. The tract of land is within the boundaries of the Talty Water Supply Corporation (the “Talty SUD”) water supply service area. However, Talty SUD is unable to provide sufficient fire flows to the tract due to undersized water infrastructure south of Interstate Highway 20.

 

Across FM 741 from the subject tract, Kaufman County Municipal Utility District No. 11 (Heartland Addition) has a water main and fire hydrant capable of providing fire flows to the tract in accordance with the City adopted International Fire Code. This agreement allows the City to access fire hydrants owned by Kaufman County Municipal Utility District No. 11 for fire suppression on the subject tract. It also allows extension of a water main to the subject tract for a fire sprinkler connection. It is anticipated this agreement is temporary and will be terminated once the City constructs adequate water infrastructure to FM 741. Domestic water service will still be supplied by Talty SUD.

 

Financial Implications

This agreement has no financial impact to the City.

 

Recommended/Desired Action

Staff recommends approval of the agreement and authorization of the City Manager to finalize and execute the agreement.
