Title

Authorize the City Manager to finalize and execute a Transfer and Service Agreement with Kaufman County Municipal Utility District No. 12 (District), Deal A Day Real Estate, LLC, a Texas limited liability company (DADRE), and Talty Special Utility District of Kaufman County (Talty SUD) to provide retail sanitary sewer service to a 0.8746-acre tract of land on the southwest corner of Interstate Highway 20 and Farm to Market Road (FM) 741 by the District for a temporary period until such time as permanent sanitary sewer service becomes available from Mesquite.

 

Body

At the southwest corner of Interstate Highway 20 and FM 741 is a 0.8746-acre tract of land owned by Deal A Day Real Estate, LLC, a Texas limited liability company (“DADRE”), seeking to develop a convenience store.

 

Across FM 741 from the subject tract, Kaufman County Municipal Utility District No. 12 (Heartland Addition) has a sanitary sewer main that can be accessed by an extension of a sanitary sewer main through the proposed Trailwinds Development.

 

This agreement allows DADRE to extend the District sanitary sewer main to the subject tract for temporary service until such time as permanent sanitary sewer service becomes available from Mesquite. It is anticipated this agreement is temporary and will be terminated once land to the south of the subject tract develops resulting in extension of a City sanitary sewer main to the subject tract. The agreement requires this extension take place within eight years of approval of the agreement.

 

The agreement also makes provisions for cooperation between the City, District and Talty SUD for meter reading and billing.

 

Financial Implications

This agreement has no financial impact to the City.

 

Recommended/Desired Action

Staff recommends approval of the agreement and authorization of the City Manager to finalize and execute the agreement.
