An ordinance authorizing the sale of beer and wine for off-premise consumption only on a certain area annexed by the City.

 

Body

In 2011, voters approved, through a local option election, the sale of beer and wine for off-premise consumption only in the City of Mesquite. In 2018, the City annexed 25.464 acres of land in Kaufman County at the corner of Interstate Highway 20 and FM 741 and zoned the property Planned Development - General Retail. The voter’s approval for beer and wine sales does not automatically extend to areas of the city that are annexed after the date of the local option election. However, Texas Alcoholic Beverage Code Section 251.725 authorizes cities to extend the areas of beer and wine sales to newly annexed areas by approval of an ordinance.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
