Title

An ordinance providing for the partial abandonment of a fire lane easement, a utility easement, a fire lane and utility easement, a drainage easement and an access easement at Market East Shopping Center, otherwise known as Emporium Phase II, Block C, Lot 1R.

 

Body

A representative of the Market East Associates, LLC, requested partial abandonment of a fire lane easement, a utility easement, a fire lane and utility easement, a drainage easement and an access easement located at Market East Shopping Center, otherwise known as Emporium Phase II, Block C, Lot 1R. (See attached legal description and sketches.)

 

Research of the Dallas County land records indicates that the subject easement was dedicated by plat in 1986 for the construction of a looped water main, drainage facility, mutual access between two lots and fire lane for the shopping center. The developer proposes to build a new shopping center building where the subject easements, water main and drainage facilities are located. The developer will relocate the water main and drainage facilities, and dedicate new easements by replat as part of the new building construction project. The fire lane and portion of the access easement are not needed.

 

Stantec Consulting Services, Inc., obtained confirmation letters from the four franchise utility companies: ONCOR Electric Delivery, Atmos Energy, AT&T and Charter Spectrum, indicating they have no facilities in the subject easement and no objection to the abandonment.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
