Title: An ordinance determining the public necessity of acquiring real property interests for construction of roadway and infrastructure improvements on the northwest corner of Forney Road and Town East Boulevard, authorizing the City Manager to acquire the real property and authorizing the use of the power of eminent domain to condemn the real property if such becomes necessary, said property being owned by Dallas Gasket and Packing Company, (approximately 1.4979 acres), and being generally located at 1717 South Town East Boulevard.

Title

An ordinance determining the public necessity of acquiring real property interests for construction of roadway and infrastructure improvements on the northwest corner of Forney Road and Town East Boulevard, authorizing the City Manager to acquire the real property and authorizing the use of the power of eminent domain to condemn the real property if such becomes necessary, said property being owned by Dallas Gasket and Packing Company, (approximately 1.4979 acres), and being generally located at 1717 South Town East Boulevard.

 

Body

On June 17, 2019, the City Council approved the construction contract with Tiseo Paving Company, for the reconstruction of infrastructure improvements for Town East Boulevard from US Highway 80 to Skyline Drive. These improvements include:

 

                     Sidewalk and Trail

                     Water and Drainage Utilities

                     Traffic Signal and Appurtenances

                     Roadway Pavement

 

In order to complete the construction of the signal and sidewalk improvements this right-of-way must be obtained. This ordinance gives the City Manager authority to negotiate and execute contracts to secure the needed right-of-way. This ordinance also includes authority for the City Manager to initiate condemnation proceedings to acquire the needed land or easements if negotiations fail in acquiring the land interests.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
