(Authorize the City Manager or his designee to revoke the bid award to Martin Marietta for refusal to contract and authorize the City Manager to finalize and execute a contract with the next low and qualified bidder, B&B Ready Mix, Inc., for Item Nos. 1-8 in the amount of $578,350.00. The term of this contract is for a one-year period with four additional one-year renewal options. The City Manager is authorized to execute the renewal options, subject to annual appropriation of sufficient funds.)

This contract will provide concrete for the Streets Division for the in-house pavement repair projects. Concrete will be used for street, alley, sidewalk and other miscellaneous maintenance project.
Bid notices were broadcast through the BidSync electronic bidding system, posted on the City's website and an Advertisement for Bid was published in the Daily Commercial Record newspaper. A total of four responsive bids were received. This bid had the option of being awarded item by item or on an all-or-none basis and to award to multiple vendors.
On October 7, 2019, City Council awarded the contract to two vendors, Martin Marietta and Argos USA, LLC. Since that award, Martin Marietta has been unresponsive and will not supply signed contracts back to the City. The contract with Argos USA, LLC, was recently executed and staff has not been able to secure the delivery of concrete in a timely manner. Therefore, staff recommends award to Martin Marietta be revoked and that all items be awarded to B&B Ready Mix, Inc. The contract with Argos will remain but the B&B Ready Mix, Inc., contract will provide the necessary alternative ordering source and to provide the missing bid items that were originally intended to be awarded to Martin Marietta.
