Title

Conduct a public hearing and consider, on second reading, an ordinance imposing a moratorium on applications and plans for development, permits, plats, verifications, rezonings and site plans for convenience stores within the corporate city limits of Mesquite, adopting written findings justifying the moratorium, providing for waivers and limited exceptions to the moratorium and establishing an effective date.

 

Body

On January 28, 2020, a temporary moratorium took effect on applications for convenience stores. The temporary moratorium will expire no later than February 9, 2020.

 

To continue the moratorium while staff reviews applicable regulations, it is necessary to conduct two public hearings and adopt an ordinance on two separate readings. The first public hearing took place during the Planning and Zoning Commission meeting on Monday, January 27, 2020, and the second public hearing took place at the Special City Council meeting on Tuesday, January 28, 2020. This is the third and final public hearing.

 

The ordinance includes a statutorily required waiver process and a procedure for other limited exceptions. The moratorium may last up to 120 days with the possibility of an extension. Unless extended, the moratorium would expire on June 2, 2020.

 

Recommended/Desired Action

Following the public hearing, action should be taken on the moratorium.
