Title

Conduct a public hearing and consider an ordinance for Zoning Text Amendment No. 2020-07 to the Mesquite Zoning Ordinance, by making certain deletions and additions to various sections all pertaining to the applicable approval criteria for Special Exceptions.

(The Planning and Zoning Commission recommended approval of the zoning text amendment.)

 

Body

Section 5-200 of the Mesquite Zoning Ordinance specifies criteria for the Board of Adjustment to approve Special Exceptions. Various other sections of the Zoning Ordinance have requirements specific to certain uses or activities for Special Exception approval. For example, Special Exceptions for front carports require consideration of whether there is alley access and if the home was built with a single-car or two-car garage. The Ordinance has not been clear that both the use specific criteria and the criteria of Section 5-200 are all applicable. This amendment makes that clarification.

 

On August 10, 2020, the Planning and Zoning Commission voted unanimously to recommend approval.

 

Recommended/Desired Action

Following the public hearing, staff recommends approval.
