Authorize the City Manager to finalize and execute a Local Agreement with the Dallas County Criminal District Attorney’s Office for the disposition of forfeited contraband, pursuant to Chapter 59 of the Texas Code of Criminal Procedure.

 

Body

This local agreement is made by and between the Dallas County Criminal District Attorney’s Office and Mesquite Police Department (MPD), pursuant to Chapter 59 of the Texas Code of Criminal Procedure. This agreement governs the disposition of the property and currency sometimes seized in civil proceedings arising from routine criminal investigations. This agreement allows the MPD to be awarded 65 percent of all seized assets compared to 75 percent in the previous 1997 executed agreement. The City Attorney’s Office has reviewed and approved the agreement as to form.

 

Financial Implications

Under the new seizure agreement with Dallas County, the MPD will be awarded 65 percent of all seized assets resulting in seizures filed by the MPD in Dallas.

 

Recommended/Desired Action

Staff recommends approval of the agreement.
