Title

A resolution approving an amendment to the agreement with Kaufman County, Texas, to participate in Reinvestment Zone Number Thirteen, City of Mesquite, Texas (Spradley Farms TIRZ), relating to the increase in the Spradley Farms TIRZ Board of Directors from seven (7) members to nine (9) members with the two (2) additional members to be designated by Kaufman County, Texas, and authorizing the Mayor to execute the Amendment.

 

Body

On August 25, 2020, the Kaufman County Commissioners’ Court approved a Tax Participation Agreement to participate in the Spradley Farms Reinvestment Zone Number Thirteen (TIRZ) and the City Council subsequently passed Resolution No. 43-2020 to approve the Agreement. One of the provisions of this Agreement was to allow the County to appoint two members to the TIRZ board of directors and this would require an amendment to Ordinance No. 4713 which created the TIRZ.

 

The Tax Participation Agreement provides that the City shall provide the County at least 30-day’s notice of any proposed amendments to Ordinance No. 4713 and further provides that any amendment shall only be effective if the amendment is also approved by the governing body of the County as an amendment to the Tax Participation Agreement. Notice to the County was provided on October 22, 2020.

 

This resolution would amend the Tax Participation Agreement to approve the amendment to Ordinance No. 4713 to change the composition of the TIRZ board. Following Council action, the Kaufman County Commissioners’ Court would approve the amended Tax Participation Agreement and appoint two members to the Board at a future regular meeting of the Commissioners’ Court.

 

Recommended/Desired Action

City staff recommends approval of the resolution.
