Conduct a public hearing for Zoning Application No. Z1120-0158, submitted by Zeeshan Ali on behalf of Saleem Rajani, Great Concepts, LLC, for a change of zoning from General Retail to General Retail with a Conditional Use Permit to allow a coin operated amusement game room with a modification to have one customer restroom instead of the required one customer restroom each for male and female, located at 1430 N. Galloway Avenue.
(One response in favor and two in opposition to the application have been received from property owners within the statutory notification area. The Planning and Zoning Commission recommends denial.)
Body
The applicant is requesting to have a four-game machine game room at the same location as the existing Grab N Go convenience store. The business also includes limited fuel sales. The applicant is further requesting a modification that would allow one restroom at the premises instead of the two required, one each for males and females.
On December 14, 2020, the Planning and Zoning Commission voted 6 to 1 (Ms. Lynn dissenting) to deny rezoning from General Retail to General Retail with a Conditional Use Permit to allow a coin operated amusement game room with a modification to have one customer restroom instead of the required one customer restroom each for male and female.
The applicant made a timely appeal on December 22, 2020.
Recommended/Desired Action
This item is for a public hearing. Should the Council approve the item following the public hearing, an ordinance will be placed on the January 19, 2020, agenda for consideration. It is staff’s opinion that the request does not meet the criteria for a conditional use permit.
