Title

An ordinance amending Chapter 14 of the City Code, making deletions, revisions and adding new sections throughout the chapter and revising Appendix D of the City Code regarding Solid Waste Administrative Fees.

 

Body

The additions and revisions to Chapter 14 are intended for the purpose of preserving and protecting the public health, safety and general welfare by requiring the proper storage and disposal of garbage, trash and solid waste.

 

Specific revisions to Chapter 14 include the following:

                     Requires all trash to be bagged.

                     Requires all trash be placed in authorized containers (containers shall not exceed 48 gallon capacity).

                     Limits when trash and recyclables can be placed out for collection (may not be placed earlier than 5:30 p.m. the day before scheduled pickup and no later than 7:30 a.m. the day of scheduled pickup).

                     Limits when large items, appliances and bulk trash can be placed for collection (may not be placed earlier than 24 hours prior to scheduled collection day, brush is exempt).

                     Limits all bulk trash placed for collection to under 8 cubic yards, which should fit into an area 5 feet tall by 4 deep by 11 feet long. Bulk trash that exceeds this amount will incur an administrative fee).

The accumulation of garbage, trash and solid waste on public and private property constitutes a public nuisance and negatively affects the overall appearance and cleanliness of the community. Amending Chapter 14 includes making deletions, revisions and adding new sections throughout the chapter and amending Appendix D by adding a new section to provide administrative fees for the following violations or services: trash not contained in trash bags and/or trash containers; use of unauthorized residential trash container; spillage, overflow or scattering of trash; improper placement or improper set-out; obstruction to solid waste collection; bulk trash exceeding 8 cubic yards; and special bulk pickup request. These administrative fees will be billed to a resident’s monthly utility bill.

 

Recommended/Desired Action

Staff recommends approval of the ordinance.
